Victoria S. Luna

Victoria Luna is a partner in the Orlando office of Cobb & Gonzalez, P.A. She has expertise in the areas of general liability, premises liability, automobile negligence, gig economy defense, and the hospitality industry. Ms. Luna has represented everyone from Fortune 500 companies to local businesses over the course of nearly 20 years of practice and has done so from every stage of litigation – from pre-suit investigation through trial to verdict. She has a particular expertise in high exposure litigation involving unique and evolving areas of liability law.
Victoria graduated magna cum laude from the honors college at the University of Alabama, where she earned a degree in Marketing and English. She was named “Outstanding Marketing Student” in the College of Commerce and Business Administration and was inducted into Beta Gamma Sigma, an honor’s society representing the top 5% of business majors. She also served as treasurer of Blue Key. Ms. Luna earned her juris doctor, cum laude, from the University of Florida Levin College of Law, where she won a national title in moot court and served on the Florida Journal of International Law, in addition to being a teaching assistant for Appellate Advocacy and a prosecutor for the university’s Student Honor Court.
Out of the office, Victoria serves on the board of the Creative City Project, which is dedicated to advancing the arts in Orlando. She is a member of the Florida Defense Lawyers Association, ClaimsXchange, DRI, and the National Association of Women Lawyers (“NAWL”). In her spare time, Victoria enjoys playing tennis, running, and visiting Orlando’s world-class theme parks with her daughter.

• Obtained a defense verdict in a premises liability claim where the plaintiff claimed she required lumbar and cervical surgeries as the result of an automobile collision. At closing, the plaintiff sought over one million dollars in damages. The jury returned a complete defense verdict, and the client was able to enforce a prior proposal for settlement to obtain attorney’s fees.
• Successfully enforced a proposal for settlement against a plaintiff following trial in a slip and fall claim where the plaintiff alleged the defendant mall negligently maintained their premises.
• Secured summary judgment in favor of a landlord where the plaintiff brought a premises liability claim alleging personal injuries on a mall’s premises. The court found the landlord owed the plaintiff no duty under Florida law.
- Procured an appellate ruling reversing the trial court’s denial of a motion to compel arbitration brought forth by a third party beneficiary to the controlling contract on the basis that the court erred by finding third parties could not enforce arbitration agreements.
- Obtained a complete dismissal with prejudice against two plaintiffs on the basis that the plaintiffs committed fraud on the court.
